Terms of Service for MomVital LLC

PLEASE NOTE: THESE TERMS CONTAIN A MANDATORY ARBITRATION CLAUSE AND CLASS ACTION WAIVER, WHICH AFFECT HOW DISPUTES WITH MOMVITAL LLC ARE RESOLVED. PLEASE READ THESE CAREFULLY. BY USING OUR APP, YOU AGREE TO THESE TERMS.

1. Acceptance of Terms

By accessing or using the MomVital mobile application ("App") and related services, you agree to be bound by these Terms and our Privacy Policy. Users must be at least 16 years of age. If you are under 16, you may only use the App with the consent of a parent or legal guardian.

2. Description of Services

MomVital LLC provides exercise programs focusing on pelvic floor exercises, Pilates, and yoga. Users can access and customize exercise plans, track progress, and manage subscriptions. Some features require payment or a subscription.

3. Account Registration

To access certain features, you must create an account and provide accurate, up-to-date information. You are responsible for the confidentiality of your login information and for any activities under your account. Notify us immediately of unauthorized use of your account.

4. Subscriptions and Payments

Access to certain features requires a paid subscription. By subscribing, you agree to the applicable subscription fees.
- Billing: Fees are billed at the start of the subscription period and automatically renewed unless canceled before the renewal date.
- Cancellation: You can cancel anytime, but refunds are not provided for partial periods. Services will remain accessible until the current billing period ends.
- Price Changes: We may change prices with prior notice. You may cancel your subscription if you do not agree with the price change.

5. User Conduct

You agree to use the App lawfully and avoid:
- Engaging in fraudulent or unlawful activities.
- Attempting unauthorized access to our systems.
- Disrupting the App's operation or other users' experience.
- Sharing offensive or harmful content.
We may suspend or terminate your account if you violate these Terms.

6. Health Disclaimer

Our exercise programs are for informational purposes only and are not a substitute for professional medical advice.
- Consult a Physician: You should consult a healthcare provider before starting any exercise program, particularly if you have underlying conditions.
- Assumption of Risk: By using the App, you accept full responsibility for any risks associated with the exercises provided.

7. Intellectual Property

All content in the App, including text, graphics, and software, is the property of MomVital LLC and protected by intellectual property laws.
- You may not copy, distribute, or modify any App content without written consent from MomVital.
- Unauthorized use of App content may result in legal action.

8. Termination

We reserve the right to suspend or terminate your account if you breach these Terms or engage in illegal activities. Upon termination, you will lose access to your account and associated data.

9. Limitation of Liability

To the maximum extent allowed by law, MomVital LLC and its affiliates will not be liable for any direct or indirect damages related to your use of the App. The App and its content are provided "AS IS," and you use the App at your own risk.

10. Changes to the Terms

MomVital LLC may update these Terms periodically. If changes are made, we will notify you through the App. Continued use of the App after updates means you accept the revised Terms.

11. Governing Law

These Terms are governed by the laws of Nevada. Any disputes will be resolved in the state or federal courts located in Clark County, Nevada.
